Many people come to attorneys after their claims have been denied and are not sure if ERISA law makes it worth fighting a decision made by the insurance company. After all if the insurance company has looked at all the facts and decided there is no reason you should be receiving benefits, how can you argue with that?
Something you have to remember is that insurance companies aren’t paying your medical bills and helping you out with your disability out of the kindness of their hearts. They are a business, and for them to be able to make money they need to make it difficult for people to collect.
Before they even look at your specific case and examine any evidence, the insurance company is considering what they can use to deny your benefits. Requesting an administrative appeal is your way to fight against this and give yourself a second chance.
Winning an administrative appeal isn’t just about proving a point, it’s about getting you the benefits you deserve. But, just as important requesting an administrative appeal give your the right to sue the insurance company if they deny this appeal. But an important thing to remember is that you only have 180 days to file this appeal and get in all evidence proving your disability. The mistake that the insurance company hopes you will make is that you will miss that deadline and that you’ll just assume that you can sue and get an attorney later.
Filing an administrative appeal means that if you win you will receive monthly benefits from the day that you were originally cutoff. For some people this can be several months or even a year or more of monthly benefit checks. Failing to properly file an administrative appeal means that you’ll lose your case forever and the insurance company gets off the hook.
