In 2008 UNUM agreed to a Class Action settlement for $40 Million, without admitting liability. The Lawsuit alleged that UNUM mislead investors by inflating their stock share price by producing inaccurate accounting and financial statements as well the improper use of disability files. This Class Action included thousands on people who bought UNUM Provident securities from March 2000 thru April 2003. The $40 Million is to be distributed to the thousands of people involved in the case.
UNUM faced another lawsuit filed on behalf of the Social Security Administration. This was filed under the federal False Claims Lawsuit. UNUM was alleged to have forced Disability claimants to apply for Social Security disability benefits, even though they were not eligible, in order to receive their insurance payments under their insurance policy. UNUM knows that it is must harder to receive social security benefits. This results in policy holders filing false and ineligible claims to the social security administration. This is done to create long delays in the UNUM’s claims process. Although most claimants apply for Long Term disability are often times encouraged to apply for social security benefits. The only one benefiting from a claim that will not receive social security benefits is UNUM.
