In this video Marc Whitehead, a Board Certified Disability Attorney, discusses UNUM LTD Policies and how a case can turn on a question of interpretation.
While UNUM insurance policies may sound good on the surface, they may actually be created with wording that allows them to deny coverage or reduce the amount of benefits payable.
One example is the inclusion on definitions of disability that are misleading or can easily be distorted.
In a recent UNUM disability case, a UNUM policy holder suffered a fatal heart attack. The claimants UNUM policy stated that a $30,000 disability benefit would be payable if the claimant should die of a heart attack- a non medical term. Extensive medical records were sent to UNUM stating the official cause of death was coronary artery disease that lead to the fatal heart attack. UNUM used that wording discrepancy as a bases for their denial stating that coronary artery disease did not meet the definition of the specified illness covered in the policy- a heart attack.
This strategy of confusing the meaning of the definition of disability allows UNUM opportunities to refuse to pay claims, even when the evidence proves otherwise.
A case can turn on a question of policy interpretation. Policies are written in UNUM’s favor as a method to protect their profits. UNUM’s slippery policy language is just one tactic. UNUM often chooses to ignore the reasonable meaning of the language in its own policy by supplying it’s own interpretation.
Do not assume UNUM’s interpretation of your policy is valid, hire an experience UNUM’s claims attorney to help you fight back with a strongly supported appeal.
This is just another example of insurance companies strategies to deny or delay the payment of a claimants rightful benefits. If UNUM has wrongfully denied your claim we can help you with our more then 20 years of disability insurance law experience.
