But what if you can’t meet the criteria? Luckily, there’s another way, known as equaling a listing, or proving equivalency.
People who can’t match a particular listing may still be able to qualify for Social Security disability benefits by using the Five Step Sequential Evaluation Process to prove to the SSA that their impairment is just as serious as anything in the Listings.
Qualifying for SSDI benefits for non-mosaic Down syndrome through this method isn’t particularly simple or straightforward, so you will benefit from the help of an experienced and knowledgeable social security disability attorney. It’s relatively simple to qualify for SSDI benefits for non-mosaic Down syndrome: you need to prove that the person in question has the disorder.
How do you do this? Documentation; It needs to be from one of the following acceptable medical sources:
- A laboratory report of karyotype analysis signed by a physician, or both a laboratory report of karyotype analysis not signed by a physician anda statement by a physician that you have Down syndrome.
OR
- A physician’s report stating that you have chromosome 21 trisomy or chromosome 21 translocation consistent with prior karyotype analysis with the distinctive facial or other physical features of Down syndrome.
OR
- A physician’s report stating that you have Down syndrome with the distinctive facial or other physical features andevidence demonstrating that you function at a level consistent with non-mosaic Down syndrome.

Proving Equivalency to Get SSDI Benefits for Non-Mosaic Down Syndrome
Not everyone can meet the SSA’s criteria for Non-Mosaic Down Syndrome, but that doesn’t mean they don’t deserve benefits.
