Senate Investigates Quality of ALJ Decisions

Just a few months ago, a Senate Subcommittee held a hearing where they argued that judges failed to address “insufficient, contradictory, or incomplete evidence,” held “perfunctory” hearings, allowed evidence to be turned in “late,” and “misused” medical listings.
Now, it’s not unusual for the government to look at how they’re doing things and try to make improvements. The problem with this particular “investigation” is that it focused solely on cases where claimants won and received benefits.

Poor Procedure or Too Many Successful Claims?

The problem with this hearing, though, is that the Senators are only attacking the favorable decisions. Why else would they only look at cases where the claimant won? Surely they could have found just as many “problems” and “inconsistencies” in cases that were decided against people seeking benefits, but drawing attention to that would be admitting that they made mistakes and should be giving out more Social Security disability benefits.
