Social Security Disability claims are evaluated using a Five-Step Sequential Evaluation process defined in the Code of Federal Regulations. In part 2 of our six-part blog series, we gave an overview of Step 1 of the Sequential Evaluation Process used by the Social Security Administration in determining eligibility for benefits under the Social Security Act. At Step 1, the SSA determines whether a claimant is working at the Substantial Gainful Activity level. Today we review step 2 of the process – Determining whether the claimant has a severe impairment?
In part 3 of our six-part blog series, we look at determining the severity of your impairment, which is Step 2 of the Five-Step Sequential Evaluation Process used by the Social Security Administration in determining eligibility for benefits under the Social Security Act.
To qualify in Step 2 of the process, you must have a severe impairment or combination of impairments that have or are expected to last at least 12 continuous month or be expected to cause death. This means that you are significantly limited in performing basic physical or mental activities.
If you provide medical evidence, you may also list subjective symptoms (for example pain). The SSA will consider each symptom when determining whether or not you have a severe impairment.
While the judge will rule on whether or not each of your symptoms and impairments are deemed severe, he or she will also consider how the combination of impairments affects your ability to perform basic work activities.
When determine your level of impairment SSA will not consider age, education or work experience.
